email Terry Welch is a member of the firm's litigation group with substantial trial, arbitration and mediation experience in federal and state courts for high-tech and innovative companies as well as Japanese and other international entities.
Mr. Welch has developed a reputation as a skilled IP and patent litigator. He has taken over several cases from national or Silicon Valley firms after having been hired originally as local or co-counsel. Results include a reversal in the Federal Circuit Court of Appeals of an unfavorable Markman ruling, overturning of an injunction against an accused infringer that the adverse party had obtained prior to Mr. Welch's involvement, findings of infringement in favor of his clients, victories on summary judgment, and the obtaining of injunctive relief.
Mr. Welch has handled trials ranging from half-day, 4-person jury trials in state court to multi-week complex federal trials. He has handled dozens of mediations and arbitrations of all shapes and sizes relating to patents, trademarks, intellectual property, and products liability.
Clients contact Mr. Welch on broad-ranging issues including, most particularly, intellectual property disputes, patent litigation, products liability, manufacturer-distributor relations, and antitrust. Representative clients include Action Target, an innovative manufacturer and worldwide distributor of reactive target systems, Geneva Steel Company, Merit Medical, Non-Invasive Medical Technologies, Dentrix Dental Systems, Henry Schein, Ortho Development, an international company with significant Japanese and Pacific-Rim involvement, HemaMetrics, a medical device company with Pacific Rim involvement, Gastec-a Japanese based manufacturer and patent-holder of high-tech gas detection tube devices, Centrex, Inc., Novell, Pioneer Equipment, Cate Equipment, Zevex and Wal-Mart.
Mr. Welch served on the Executive Committee of the Young Lawyers Division of the Utah State Bar in 1993-1994 and is currently a member of the Intellectual Property division. He is a member of AIPLA (American Intellectual Property Law Association).
